9:15 a.m. Tuesday, May 2, Provident Drive, north of Provident Court, Warsaw. Drivers: Patty J. Byrer, 67, West CR 200S, Warsaw, and Amber L. Rooney, 34, West CR 600S, Mentone. The vehicles collided when Byrer pulled out of a parking lot while Rooney was traveling northbound on Provident Drive. Damages up to $2,500.

12:10 p.m. Tuesday, May 2, North Detroit Street, north of East Arthur Street, Warsaw. Drivers: Aubrey P. Smith, 24, South Water Street, South Whitley, and Gage E. Webb, 21, South Market Street, Burket. The drivers were pulling out of parking lots on opposite sides of Detroit Street. Both drivers pulled out of the parking lots they were in at the same time, causing their vehicles to collide in the middle of North Detroit Street. Damages up to $10,000.


Warsaw Woman Enters Home, Batters Another Woman With Can

WARSAW — A Warsaw woman is facing battery charges after entering a home and battering another woman.

Kathy Ann Buckheit, 54, 312 N. Washington Street, Warsaw, is being charged with residential entry, a level 6 felony, battery, a class A misdemeanor, and resisting law enforcement, a class A misdemeanor.

According to the affidavit of probable cause, an officer with the Warsaw Police Department responded to a  residential entry and battery on April 27.

Upon arrival the officer spoke with the female victim who advised she was laying on the couch when Buckheit entered her home without permission. Buckheit then ran at the woman and began hitting her in the head with a can before getting on top of her and striking her three more times before falling to the floor.

The victim observed Buckheit pick up a knife and sought safety in the bathroom to call 9-1-1. Buckheit left the residence.

The affidavit states the officer found Buckheit and spoke with her. Bucket admitted to entering the victim’s residence and battering her. When the officer told Buckheit she was under arrest she became belligerent and attempted to kick him. The officer took Buckheit to the ground and was able to handcuff her.

Buckheit was booked in the Kosciusko County Jail on April 27 and held on $5,250 surety and cash bond.

3:41 p.m. Tuesday, May 2, East Winona Avenue, Warsaw. Drivers: Ashley L. Palazzolo, 27, North CR 400E, Warsaw, and Peggy D. Wilson, 74, North Fox Farm Road, Warsaw. The vehicles collided as both drivers were backing out of parking spaces. Damages up to $2,500.

5:30 p.m. Tuesday, May 2, Lake City Highway, west of East CR 200N, Warsaw. Drivers: Daniel Apostu, 42, Cover Lane, Glenview, Ill., and Luke A. Kohls, 52, Palace Drive, Roanoke. Apostu rear-ended Kohls’ vehicle. Damages up to $5,000.

Odor Leads Officers To Discover 90 Grams Of Marijuana, 11 Firearms And Cocaine

WARSAW — After detecting a strong odor of marijuana coming from a specific residence, officers locate over 90 grams of marijuana, cocaine and 11 firearms.

Enrique Manuel Ramos, 41, 1824 Michaels St., Warsaw, is being charged with possession of cocaine while in possession of a firearm, a level 5 felony; obliterating identification marks on a firearm, a level 5 felony; dealing in marijuana in excess of 30 grams, a level 6 felony; maintaining a common nuisance, a level 6 felony; and possession of marijuana, a class B misdemeanor.

On April 5, an officer with the Warsaw Police Department responded to a strong odor of marijuana coming from a residence on Michaels Street, Warsaw. The officer was greeted by Ramos and told him to gather everyone in the living room of the house to secure the home for further investigation. Ramos did not comply and locked the screen door.

A woman then came to the door and the officer told her the same thing. She also closed the door on the officer. The officer could see a small child walking through the house. Further officer assistance was requested.

According to the affidavit of probable cause filed on May 1, additional officers arrived and helped secure the residence. Inside the home was Ramos, his wife, two teenagers and a small child. A search warrant was obtained for the residence.

In the master bedroom dresser, officers discovered smoking devices, marijuana paraphernalia, chunks of marijuana, digital scales, a revolver, two drug ledger books with information, 2.9 grams of hash oil and a cocaine one-hitter.

A locked safe was located inside the bedroom closet. Inside the safe, officers located 3 plastic bags of marijuana weighing 90.2 grams. The bags had markings on them commonly used for dealing drugs. Officers also found multiple smoking devices, metal grinders with marijuana residue, a water bong and three glass jars with marijuana residue.

In the garage trash bag officers found multiple plastic bags with marijuana residue and similar dealing markings. A blue bag that contained cocaine and a dollar bill with cocaine residue were also discovered.

Throughout the house, officers were able to locate 11 firearms including shotguns, rifles and handguns. One handgun had the serial numbers scratched off of it. An officer was able to obtain the serial numbers and discovered the gun had been reported stolen to the Mishawaka Police Department on March 10, 2011. The gun had been stolen during a home burglary.

Ramos was booked into the Kosciusko County Jail on April 5 with a $10,250 surety and cash bond.

Warsaw Man Facing Charges After Breaking Into Explorer Van

WARSAW — A Warsaw man is facing burglary charges after breaking into Explorer Van and stealing merchandise.

Jacob David Anderson, 25, 711 E. Main St., Warsaw is being charged with burglary, a level 5 felony, and theft, a level 6 felony.

According to the affidavit of probable cause, on April 30, an officer with the Kosciusko Sheriff’s Department was dispatched to Explorer Van in Warsaw for a burglary.

When the deputy arrived, he met with an employee of Explorer Van and Anderson. The employee explained he had found Anderson inside a secured, fenced-in area of Explorer Van.

The employee told officers when he had arrived at work, he had found Anderson and another male walking along the south side of the building. The employee said that the males ran from him through the building.

He had been able to catch up to Anderson but the other male fled.

Officers spoke with Anderson who admitted that he and the other male had parked Anderson’s girlfriend’s minivan outside of Explorer Van. Anderson admitted he knew the gate code to enter the secured grounds and stole televisions and auto parts exceeding $750 in value.

Officers located multiple flat screen televisions, television boxes and a conversion van bench seat, that were all property of Explorer Van, in Anderson’s girlfriend’s van.

Officers believe Anderson’s accomplice to be a former employee of Explorer Van.

Anderson was booked in the Kosciusko County Jail on April 30 with a $10,250 surety and cash.

6:07 a.m. Wednesday, May 3, South SR 15 and West CR 200S, Warsaw. Drivers: Travis D. Shepler, 47, North CR 700W, Nappanee, and Ryan J. Sparks, 30, North Shagbark Drive, Warsaw. The vehicles collided when Shepler thought Sparks was making a right turn and started to go around his vehicle. Sparks actually turned left and struck the side of Shepler’s vehicle. Damages up to $10,000.

7:42 a.m. Wednesday, May 3, East Market Street and South High Street, Warsaw. Drivers: Ronie S. Rom, 18, East Levi Lee Road, Warsaw, and Brenda E. Smith, 53, South SR 25, Warsaw. The vehicles collided when Rom pulled onto Market Street and struck Smith’s vehicle. Damages up to $5,000.

9:57 a.m. Wednesday, May 3, North Detroit Street and East Man Street, Warsaw. Drivers: Todd W. Walls, 55, West Walnut Street, Pierceton, and Gina L. Garza, 52, East Clark Street, Warsaw. The vehicles collided at the intersection. Early reports indicate Walls may have failed to stop at a red light. Damages up to $5,000.

Milford

Officers with the Milford Police Department investigated the following accident:

12:59 p.m. Wednesday, May 3, North SR 15 and Turkey Creek Drive, Milford. Driver: Jack R. Friedman, 64, Stonebridge Drive, Elkhart. Friedman advised he swerved to avoid striking a dog that ran out on the roadway. Friedman struck a guardrail. Damages up to $25,000.

Jackson Pleads Guilty In Two Cases, No Longer Faces Attempted Murder Charge

KOSCIUSKO — Alexander Jackson, 24, 11548 North SR 13, Syracuse, has pled guilty in two attacks of the same man that took place in July and September 2016. Jackson no longer faces an attempted murder charge.

Pursuant to a plea agreement, Jackson is pleading guilty to attempted aggravated battery, a level 3 felony; battery causing bodily injury to law enforcement, a level 5 felony; resisting law enforcement, a level 5 felony; and criminal recklessness, a level 5 felony.

The original attempted murder charge was reduced to the new attempted aggravated battery charge. An invasion of privacy charge is completely dropped from the case.

On July 27, 2016, the victim in the case was chased in his vehicle and shot at by Jackson. Jackson rammed his vehicle into Kosciusko County Sheriff’s Deputy Don McCune’s vehicle, who then shot Jackson to stop his aggression. This original case led to Jackson being charged with attempted murder, battery resulting in bodily injury to a public servant, resisting law enforcement and two counts criminal recklessness.

On Aug 1, 2011, the victim involved with the vehicle chase obtained a protective order against Jackson. The protective order states that Jackson is to refrain from harassing, annoying and direct or indirect contact with the victim.

On Sept. 11, 2016 the victim was driving with his wife southbound on SR 13 in Syracuse. He observed a black Chevy flatbed truck, driven by Jackson, headed northbound on SR 13. The black truck intentionally veered into the victim’s lane of traffic, coming directly toward him. The victim advised that he feared for his and his wife’s safety. Jackson was then additionally charged with intimidation with a deadly weapon, intimidation, criminal recklessness while armed with a deadly weapon, and invasion of privacy.

Jackson will appear for sentencing at 9:30 a.m. on June 30 in Elkhart County. This case is not being handled by Kosciusko County because Jackson’s father, Brad Jackson, is a Kosciusko County Commissioner.

11:05 p.m. Wednesday, May 3, West CR 250S, Warsaw. Driver: Nathaniel L. Hall, 38, West CR 250S, Warsaw. Hall attempted to avoid a dog that was on the road. He steered around the dog, overcorrected and went off the right side of the road, down a ditch and struck some trees. Damage up to $5,000.

Syracuse Woman Facing Charges For Stealing Nearly $40,000 To Fund Drug Habit

WARSAW — A Syracuse woman is facing charges after allegedly stealing nearly $40,000 from her grandparents to fund her drug habit.

Stephanie Orten, 902 North Huntington St., Syracuse, is being charged with fraud and theft, both level six felonies.

According to the affidavit of probable cause, Orten’s charges stem from fraudulent ATM withdrawals that began late last year. On Jan. 30, an individual reported to officials that someone had been withdrawing money from his in-laws account without their permission.

From Oct. 17, 2016, and Jan. 20, there were approximately 69 unauthorized ATM cash withdrawals and an unknown number of debit purchases that had appeared on the elderly couple’s bank account.

According to the affidavit of probable cause, the male told police his in-laws had allowed their granddaughter, Orten, to use their debit card to purchase groceries and necessities for them because they are in poor health.

Police discovered that Orten made fraudulent ATM withdrawals and debit card purchases unauthorized on her grandparent’s card totaling $39,100.75.

On Feb. 3, officers spoke with Orten who stated her grandfather had given her the card to purchase groceries and other necessities. She did not have authorization to make ATM withdrawals or debit transactions. Orten told police she used the money from the withdrawals to support her $300 to $400 a day drug habit.

Orten was booked on Thursday, May 4, on a $45,000 surety and cash.
