12:17 p.m. Saturday, April 29, Lake City Highway, Warsaw. Drivers: Darcey R. Davis-Vilamaa, 39, North Shagbark Drive, Warsaw, and Lloyd E. Graber, 67, North CR 100W, North Manchester. Graber rear-ended Davis-Vilamaa. Damage up to $5,000.

7:45 p.m. Saturday, April 29, Sophie Lane, Warsaw. Drivers: Ely J. Wendt, 20. East Lantern Road, Warsaw, and Lucino M. Magno, 42, North CR 225E, Warsaw. As Wendt was attempting to back out of a parking space, she collided with Magno. Damage up to $5,000.

8:14 a.m. Sunday, April 30, West CR 350N and North Detroit Street, Warsaw. Driver: Alonzo J. Villarreal, 18, Hackleman Street, Warsaw. Villarreal was southbound on North Detroit Street. As he approached the intersection at West CR 350N, he began to turn left. Villarreal turned sharply to avoid a vehicle, overcorrected and slid into a NIPSCO utility pole. Damage up to $10,000.

WARSAW — A Warsaw woman has been arrested after a victim received a letter from the Internal Revenue Service stating she owed money for an unclaimed W-2. The W-2 form was filed by a New Paris business, Veada Industries.

Arisbe Rodriguez

Arisbe Rodriguez, 40, 3762 W. Old Road 30, Warsaw, is being charged with identity deception and forgery, both level 6 felonies.

On April 25, the victim contacted a Warsaw Police Officer about the letter from the IRS. The letter included the W-2 form with her name and social security number attached. The victim had never been employed by Veada Industries and advised that someone was using her identity without her consent.

The officer contacted Veada industries and found out they had an employee with the victim’s name. The officer obtained the employment information along with a driver’s license and social security card, all containing the victim’s name and information. The photograph on the driver’s license was not the victim.

On April 28, the officer traveled to Veada Industries and spoke with the employee who identified herself as the victim. She then admitted her real name was Arisbe Rodriguez. She advised she had purchased the social security card and driver’s license from individuals in Warsaw. She then began working at Veada Industries on Oct. 19, 2015.

According to the affidavit of probable cause, Rodriguez advised she did not have permission to use the victim’s identifying information. She provided the false driver’s license to the officer. The license was fraudulent and did not have the state of Indiana seal.

Rodriguez was booked into the Kosciusko County Jail on April 28 with a $5,250 surety and cash bond.

Holle To Serve Two Years For Child Pornography

Bart Lane Holle

WARSAW — A Warsaw man who was arrested in November 2016 for having more than 1,000 images of child pornography was sentenced today, May 1, in Kosciusko Circuit Court with Judge Michael Reed presiding.

Bart Lane Holle, 57, Warsaw, was sentenced on two counts of possession of child pornography, both level 5 felonies.

Holle’s arrest was a coordinated effort between the Indiana State Police Crimes Against Children, the Warsaw Police Department, the Kosciusko County Prosecutor’s Office and the Butler Police Department.

On Nov. 15, Holle was located at his job in Nappanee by troopers and taken back to his home at 505 Alward St., Warsaw, where he was later placed under arrest. Officers had obtained a search warrant for Holle’s home and cellular phone where they discovered more than 1,000 illegal images of children.

CAC Trooper Gretchen Smith led the investigation of Holle working as a member of the Internet Crimes Against Children Task Force (ICAC). Smith said she received information on Holle from a local cellular telephone store when he attempted to have pornographic images of children transferred to a new phone.

Prosecuting attorney Daniel Hampton advised the court that Holle had taken responsibility for his actions, cooperating fully with the investigation.

When Holle spoke to the court he said he was sorry he had looked at the pictures, advising he didn’t realize it was wrong at the time. “I never meant to harm anyone in anyway,” stated Holle, further saying that he will never look at such pictures again.

After Holle asked forgiveness, Judge Reed explained that forgiveness is not the court’s job.

Judge Reed accepted Holle’s plea agreement, finding him guilty of two counts of possession of child pornography, level 5 felonies, and dismissing one count of possession of marijuana.

For those two counts Holle received three years each at the Kosciusko County Jail, to be served concurrently, with one year suspended on probation.

Holle will be able to serve his time on work release if he is approved. He will receive three days jail time credit for time already served.


South Whitley Man Travels To Have Sex With ‘Teen’ Who Is Actually A Deputy

SOUTH WHITLEY — A local man was arrested after he traveled to Muncie in hopes of having sex with a 15-year-old girl. The “girl” ended up being a deputy who was conducting a sting operation.

Christopher Lung

Christopher Lung, 41, 9649 W. CR 250S, South Whitley, is being charged with attempted sexual misconduct with a minor, a level 4 felony, and child solicitation, a level 5 felony.

According to the affidavit of probable cause, a Delaware County deputy placed an online ad stating he was a runaway who needed comfort. Lung responded to the ad and a long text message conversation began.

The deputy identified himself as a 15-year-old girl with photos taken off of Google. Lung sent the deputy a nude picture of himself and then asked for another picture of the girl. The “girl” told Lung that she had only had sex with one person. Lung replied that he would help her with that.

The two agreed to meet at the Muncie mall on April 28. Several police units were in the parking lot waiting and performed a traffic stop on Lung. He was positively identified by tattoos that were in the nude picture sent to the deputy.

Lung admitted to officers that this was his first time picking up a minor but not his first time picking up escorts online. He advised he knew that what he was doing was wrong. Lung was reported as very nervous and “sweating profusely” throughout the whole interview. He stated that this was going to ruin his life forever.

Lung has posted a $30,000 bond and has been released from jail.

Officers with the Goshen Police Department investigated the following incidents:

  • 9:25 a.m. Sunday, April 30, North Main Street, Goshen. Sukhwinder Singh, 27, Syracuse, an employee at Phillips 66, 224 N. Main St., reported while working money had been taken from the business by force. The subject presented a folding knife and then took an undisclosed amount of cash. There were no injuries, or suspect at this time and the incident remains under investigation.
  • 6:47 p.m. Friday, April 28, Brookside Manor, Goshen. Jason Huston, 37, Milford, reported a custody dispute. An officer responded and a report taken to document the incident.
  • 4:23 p.m. Friday, April 28, US 33, Goshen. Following a traffic stop at 66542 US 33, Goshen, Police arrested Daniel Zeringue Jr., 32, 345 N. SR 19, Etna Green, was arrested for possession of marijuana and an Elkhart County warrant and Angela Suter Tjemagel, 36, 2762 W. Old Road 30, Lot 22W, Warsaw, was arrested for a Kosciusko County and Goshen warrant. Both were taken to the Elkhart County Correctional Complex.

Jones over-turned and then over-corrected while turning at the intersection, striking WIley’s vehicle. Damage up to $1,000.

5:19 a.m. Monday, May 1, West Market Street and South Lake Street, Warsaw. Drivers: Alison M. Ousley, 25, Wooster Road, Winona Lake, and Norma Meza, 41, East CR 200N, Warsaw. Ousley attempted to stop at the light when her brakes failed, causing her to collide into Meza’s vehicle. Damage up to $5,000.

5:51 a.m. Monday, May 1, South Hand Avenue, north of West Winona Avenue, Warsaw. Drivers: John E. Mattson, 28, South Mallard Road, Mentone, and Alicia M. Henriott-Conner, 29, East CR 500N, Rochester. Mattson rear-ended Henriott-Conner when Henriott-Conner braked to avoid flooding. Damage up to $2,500.

Burt Receives Sentence For Crash Resulting In The Death Of A Warsaw Architect

Carl Burt

WABASH — A Warsaw resident was sentenced to seven years of prison time and one year of probation after pleading guilty, but mentally ill, to charges stemming from an accident that took the life of Warsaw architect Mary Ellen Rudisel-Jordan 2013.

On Monday, May 1, Carl Burt, Warsaw, received his sentencing at Wabash Circuit Court. He pleaded guilty, but mentally ill, to a charge of reckless homicide, a level C felony. Two other charges were dropped per the plea agreement.

Burt’s sentencing stemmed from an accident that occurred July 18, 2013. When the Wabash County Sheriff’s Department arrived to the scene of the accident, Mary Ellen Rudisel-Jordan was found dead in her vehicle in a field. Burt had been reportedly driving erratically shortly before the accident occurred.

Burt was unable to give police a statement at the scene due to injuries sustained during the crash.

Although he is unable to recall the accident, Burt has expressed he believes witnesses who have testified he caused the crash. A toxicology blood test revealed Burt was positive for Diazepam, Nordiazepam, Oxazepam and Temazepam. The levels, according to a toxicology analytical supervisor, would be recognized as high enough levels to be considered impaired.

During the sentencing, Burt’s lawyer, Alan Zimmerman, mentioned Burt continues to suffer from brain injuries, spinal fractures, multiple traumas, chronic confusion and other injuries as a result of the accident.

Judge Robert McCallen III asked if any of Rudisel-Jordan’s family members would like to speak during the sentencing but received no response. McCallen indicated he understood the family has gone through much distress with the death, but he did want to know what the family’s wishes were regarding the sentencing.

McCallen noted he had taken Burt’s three prior convictions regarding the misuse of vehicles into consideration for the sentencing.

Burt received seven years of jail time and one year of probation. He received one day of jail time credit. McCallen stated he would not be opposed to Burt serving his sentence at an approved medical facility.

“He still gets to go home when all is said and done, that says more than for the deceased.”

Milford Man Facing Felony Intimidation Charge After Text Message

Jose Munoz, Jr.

MILFORD — A man is facing a felony intimidation charge after he texted his ex-girlfriend and insinuated he would kill her.

Jose Munoz, Jr., 36, 305 Heide Lane, Milford, is being charged with intimidation, a level 6 felony, and harassment, a class B misdemeanor.

On March 5 an officer with the Milford Police Department spoke to a woman who advised Munoz had sent her harassing and threatening messages to kill her.

According to the affidavit, when the officer spoke with the ex-girlfriend she advised that Munoz had broken into her home through the front door before. The officer noted that it was clear she was scared Munoz would harm her.

The affidavit states that the officer was shown text messages from Munoz which stated, “I will end you and you are going to hell with me,” further stating, “I’m not going to give up.”

The ex-girlfriend stated she does not feel safe at night and has trouble sleeping as she is concerned Munoz will break in and kill her before police arrive.

Munoz was booked into the Kosciusko County Jail on April 22 and held on a $6,000 surety and cash bond.

11:02 a.m. Monday, May 1, 540 E. Market St., Warsaw. Driver: Adrian Rose, 68, North Colfax Street, Warsaw. Rose hit a light pole in the Dollar General parking lot. Damage up to $5,000.

2:45 p.m. Monday, May 1, West Market Street and South Columbia Street, Warsaw. Drivers: Hector Ibarra, 44, Wooster Road, Winona Lake, and Elisa C. Tinsley, 25, East Main Street, Atwood. Tinsley stopped at a stop sign; Ibarra slid on the wet pavement and rear ended Tinsley’s vehicle. Damage up to $5,000.

11:09 a.m. Monday, May 1, Argonne Road and East Market Street, Warsaw. Driver: unknown, and Cameron C. Thomas, West CR 900N, Milford. An unknown driver in a small black car disregarded a stop sign and collided with Thomas’s vehicle. Thomas advised the driver had gotten out of the vehicle, stated he was being chased and that someone was trying to kill his family, got back into his vehicle and left. Damage up to $2,500.

Officers with the Kosciusko Sheriff’s Department investigated the following accident:

6:30 p.m. Monday, May 1, East Armstrong Road, east of T25 Lane, Leesburg. Driver: Stephen Ledgerwood, 27, East CR 500N, Leesburg. Ledgerwood drove off of Armstrong Road, laying his bike down. Ledgerwood complained of leg pain but denied medical assistance. Damage up to $5,000.

WARSAW — A Warsaw man has been arrested after his son told an employee of the Department of Child Protective Services that his dad became angry and hit him with a closed fist. The child said he was told to lie about the incident and say it was an accident.

Nathaniel James Hollett

Nathaniel James Hollett, 30, 752 East CR 300N, Warsaw, is being charged with domestic battery with bodily injury to a person less than 14 years of age, a level 5 felony, and interference with the reporting of a crime, a class A misdemeanor.

On March 20, an officer with the Warsaw Police Department responded to a welfare check. A Madison Elementary School resource officer had been contacted in regards to a student missing school because of a black eye.

The officer arrived at the child’s home and spoke with the mother. She advised that Hollett did give the child a black eye but that it was an accident. She claimed the incident occurred while Hollett was retrieving a bed sheet from the closet. According to the story, Hollett jerked the sheet and his elbow hit his son in the eye.

At this point, the child confirmed his mother’s story.

An employee of the Department of Child Services then conducted an interview with the child on March 21 at his school. The child said that his father had became angry and hit him on the eye with a closed fist. According to the child, he was told to lie if he was questioned about the black eye. Hollett told him that he told the “right story” he would get to go somewhere fun.

According to the affidavit of probable cause, DCS then asked the child if he feels safe at home. The child responded, “I feel safe unless daddy is mad.”

Hollett currently has charges pending in Kosciusko County Superior Court. One charge for strangulation and two for domestic battery.

He was booked into the Kosciusko County Jail on April 30 with a $16,000 surety and cash bond.

 

Two Men Arrested When Meth Is Found While Warrant Is Served

WARSAW — One man is being charged with possession of a syringe while another faces charges of possession of methamphetamine after they were served warrants.

Alonzo Esteban Villarreal, 36, 821 E. Smith Street, Warsaw, has been charged with possession of a syringe, a level 6 felony. Scott Elliot Cochran, 34, 433 W. Center Street, Warsaw, has been charged with possession of methamphetamine, a level 6 felony.

According to the affidavit of probable cause, an officer with the Warsaw Police Department was northbound on Detroit Street, Warsaw, on April 25 when he recognized a passenger in a vehicle as Cochran, who had a felony warrant for his arrest.

The officer followed the vehicle into a bait shop and approached the men. At this time the officer also recognized Villarreal who also had a warrant for his arrest.

The officer observed the two men moving around. Upon removing Cochran from the vehicle, officers found a plastic bag containing a white powder that field tested positive for meth. The affidavit continues, stating that under the seat officers found a five and ten dollar bill with a white powdery substance that also tested positive for meth.

Officers then searched Villarreal and found a hypodermic syringe. According to the affidavit, Villarreal admitted to using the syringe to inject methamphetamine.

Cochran admitted to possessing the meth.

Both Cochran and Villarreal were booked in the Kosciusko County Jail on April 25.
