Akashia Garber

WARSAW — A Warsaw woman was sentenced in Kosciusko Circuit Court Monday, April 2, after she was found in possession of methamphetamine during a traffic stop.

Akashia Garber, 25, 2886 S. Woodland Trail, Warsaw, was found guilty of possession of methamphetamine, a level 6 felony; possession of paraphernalia, a class C misdemeanor; and failure to appear, a level 6 felony.

According to the affidavit of probable cause, on Saturday, March 11, 2017, an officer with the Warsaw Police Department witnessed a vehicle traveling on North Detroit Street with only one working headlight. The officer conducted a traffic stop and identified the front seat passenger as Garber.

The officer was notified that the male driver had an active arrest warrant out of Virginia. As the officer talked to the occupants of the vehicle, an officer with the Kosciusko County Sheriff’s Department had his K9 partner do an outer air search on the vehicle. The K9 responded positive for the presence of illegal narcotics inside the vehicle.

According to the affidavit of probable cause, a small box was located inside the vehicle. The box contained a glass smoking pipe, a plastic bag of methamphetamine, three cut straws, a hollowed out pen and three hydrocodone pills. On the front passenger floorboard was a grey bag. Inside the bag, officers discovered Garber’s birth certificate and four cut straws with methamphetamine residue.

Officers searched the male driver and also discovered a small plastic bag containing memory cards and methamphetamine. The male admitted that the box and everything in it belonged to him. Garber admitted that the bag and everything in it belonged to her. Garber further admitted to using methamphetamine earlier in the day.

For the possession of methamphetamine charge, Judge Michael Reed sentenced Garber to two and a half years in the Kosciusko County Jail. Garber was sentenced to sixty days in the Kosciusko County Jail for the possession of paraphernalia charge. For the charge of failure to appear, Reed sentenced Garber to two and a half years in the Kosciusko County Jail. Reed ordered the sentences to be served concurrently. Garber was given jail time credit of 53 days and ordered to pay a $100 fine. Reed ordered the balance of the sentence to be served on formal probation.

Winona Lake Man Receives Suspended Sentence After Making Statements About Shooting Fellow Employees

Sammual Miller

WARSAW — A Winona Lake man received a suspended sentence Monday, April 2, in the Kosciusko Circuit Court after reportedly describing to co-workers how he would shoot fellow employees if he were ever fired from his job.

Sammual Miller, 29, 1206 Wooster Road, Winona Lake, was found guilty of possession of paraphernalia, a class C misdemeanor.

Miller, a former KGP Logistics employee, was arrested for intimidation in December after he told two co-workers how he would shoot all employees if he ever got fired.

According to the affidavit of probable cause, on Nov. 30, an officer with the Warsaw Police Department responded to an intimidation call at KGP Logistics. A human resources employee advised that while working on third shift, Miller went for a break and was found asleep in his vehicle. Employees tried to wake him by banging on the vehicle, but it took five minutes to wake him up. Because Miller was so deeply asleep, drug use was suspected, with the company planning to do a drug test and possibly terminate him.

At this time, two employees notified the human resources employee that sometime between October and November they had a frightening conversation with Miller. According to the employees, Miller told them if he was ever fired by phone, he would come to the back of the business, go over a fence and move through the building, shooting all the employees. He noted he would have to do it quickly to make it to the other side of the building before people escaped.

Both employees told the officer the same details. One of the employees further advised he was afraid because he had sold Miller a rifle approximately seven months prior.

The officer spoke with Miller, who admitted he had talked about “shooting the place up.” He told the officer he would force everyone to the side of the building with only one exit. He further admitted to having a rifle at his residence. The officer went to Miller’s residence and found the firearm, which was taken as evidence. The officer also found a glass smoking device that contained burnt marijuana.

Deputy Prosecuting Attorney Brad Voelz made it a point to clarify that nothing about this plea agreement or conviction has any effect on a civil protective order that is still in place in Superior Court 3, stating that the order remains in full force and effect until December 2019.

“Sometimes work places can remind one of high school, with people not liking other people and talking about other people and exaggerating,” said Miller’s attorney, Jay Rigdon. “It appears that’s what you ended up with here.”

“The intimidation charges had no merit,” Rigdon added.

Judge Michael Reed sentenced Miller to sixty days in the Kosciusko County Jail, with the sentence suspended, providing Miller commits no further offenses. Miller was ordered to pay a $100 fine, a $200 drug interdiction fee and $300 in public defender reimbursement fees. Reed ordered that Miller’s firearm be forfeited to the Warsaw Police Department.

Two counts of intimidation were dismissed, pursuant to the plea agreement.

Deshario Antwain Purnell

WARSAW — Two Chicago men were arrested after stealing $4,000 worth of alcohol and cigarettes from Service Liquor, Warsaw.

Troy Demetrius Walker, 28, 11326 S. Union Ave., Chicago, Ill., and Deshario Antwain Purnell, 25, 8337 S. Oglesby Ave., Chicago, Ill., are each being charged with two counts of fraud and two counts of theft, all level 6 felonies.

On March 31, police responded to a report of theft at Service Liquor.

According to the affidavit of probable cause, Purnell entered the store and attempted to purchase alcohol. He told an employee that his credit card probably wouldn’t work since he had exceeded his spending limit for the day.

The employee attempted to run the credit card two times but it was declined. Purnell told the employee to use the force option and the employee told Purnell that he needed to contact his bank. The employee stated that it appeared like Purnell had contacted his bank, but he suspected that he wasn’t talking to anyone because he didn’t hear a voice on the other end.

Purnell gave the employee a code to use and the force option worked. $3,182.95 worth of alcoholic beverages were stolen.

After loading the alcohol into his vehicle, Purnell entered the store again, using the force sale option to purchase $975.41 worth of cigarettes.

While in route to Service Liquor after receiving the report, officers located the suspect vehicle. Purnell was operating the vehicle, and Walker was a passenger. As Walker exited the vehicle, several unopened cartons of cigarettes fell out of the passenger side door.

Purnell told officers that the card he used was not declined and that he didn’t tell the clerk to use the force sale option. Walker told officers that he didn’t get out of the vehicle and didn’t know anything about what was going on.

Video from the store shows that while appearing to call his bank, Purnell’s phone was on the homepage and wasn’t actually being used.

Both men were booked into the Kosciusko County Jail on March 31, each with a $5,250 surety and cash bond.

WARSAW — A Pierceton man is charged with several counts after police say he robbed the home of a deceased woman in September 2017. He was picked up this week on a warrant.

Christopher Wayne Burnworth, 36, 8280 E. US 30, No. 29E, Pierceton, is charged with burglary, a level 4 felony and theft, a class A misdemeanor.

Christopher Burnworth

A woman reported inheriting her late mother’s home in Pierceton and told police that someone had forced their way into the home and took items between Sept. 11, 2017 and Sept. 20, 2017. Police found the screen had been cut on the rear door to the residence and that a pry bar had also been used to gain entry to the house.

After talking to a neighbor, police learned that dogs had been barking on Sept. 19. The neighbor’s husband checked the next door residence the following day and found the damage. He then reported the damage to the deceased woman’s daughter.

Police interviewed a witness who said Burnworth had approached him about buying some jewelry, which Burnworth said he had stolen from the residence of a deceased elderly woman. The witness told police he refused to buy the jewelry and a second witness said Burnworth gave him the items to hold. That witness, according to police, turned over the items, which were identified by the daughter as having belonged to her late mother.

Burnworth was booked on a warrant into the Kosciusko County Jail on April 3, with a $30,250 surety and cash bond.

Alexzandrea Tefft and Jeffery Rhoades

SYRACUSE — Police responded to complaints at a Syracuse hotel late last month that resulted in the arrests of a man and woman on drug charges.

Alexzandrea Y. Tefft, 24, 2207 Mather Ave., Elkhart, and Jeffery W. Rhodes, 29, 5310 North CR 850E, North Webster, are both charged with possession of methamphetamine, a level 6 felony, possession of marijuana, a class B misdemeanor and possession of paraphernalia, a class C misdemeanor.

According to the probable cause affidavit, police responded to a complaint of illegal drugs at the Brooke Pointe Inn in Syracuse. An employee told police that staff had observed a diaper bag that contained what they believed to be marijuana. The witness also said there was a smell of burnt marijuana from one of the hotel’s rooms.

Police said when they knocked on the door of the room, Rhoades answered and invited them in. Police reported smelling burnt marijuana inside the room and said Rhoades admitted to smoking the drug inside the room. The report said Rhoades also told police there was marijuana inside a back pack sitting on the bed. He then gave police permission to search the bag, which police say had not only marijuana in it, but also marijuana-related paraphernalia and a bag of white powder, which field tested positive for methamphetamine.

Rhoades told police that Tefft was outside in the parking lot. Police reported that Tefft was standing next to Rhoades’ car. According to the report, a diaper bag was seen inside the car, which Tefft gave police permission to search. More items connected to the two drugs, as well as paraphernalia were found in diaper bag.
