Warsaw Man Arrested After Threatening To Fight Officers, Burn Their Houses Down

WARSAW — A Warsaw man threatened to fight several officers after they attempted to calm him down. During the arrest, he continued to threaten them and at one point stated he was going to burn their houses down.

Toby Daniel Jackson

Toby Daniel Jackson, 35, 30 EMS B34 Lane, Warsaw, is being charged with intimidation, a level 6 felony, and disorderly conduct, a class B misdemeanor.

On June 3, an officer with the Kosciusko County Sheriff’s Department responded to a verbal altercation. Upon arrival, the officer witnessed Jackson yelling at a female subject. The officer attempted to calm Jackson down and figure out what was making him upset.

According to the affidavit of probable cause, Jackson told the officer he was going to fight him and that he couldn’t believe they only sent one officer. After this threat, two other officers came to assist with the arrest. Jackson continued to threaten the officers.

At one point, Jackson clenched his fists and moved towards an officer. Jackson told another officer that he was going to punch him in the face and give him a black eye. Jackson was put under arrest and placed in the back of the patrol vehicle.

Even after being placed under arrest, Jackson continued to threaten the officers. He told them he better get a spit hood because he has Hepatitis C and was going to spit all over and bite the officer on the face. He also threatened to burn all the officer’s houses down.

 


Cochran Sentenced On Drug Charges

Scott Cochran

WARSAW —  A Warsaw man was sentenced today, June 12,  for charges stemming from two separate cases.

Scott Elliot Cochran, 433 W. Center Street, Warsaw, was sentenced on charges of possession of meth and possession of a narcotic drug.

Cochran’s charges stem from officers finding drugs in his possession during traffic stops.

According to an affidavit of probable cause, the first incident occurred May 28, 2016, during a traffic stop, due to Cochran’s failure to dim his brights, officers searched Cochran’s vehicle and found a cut piece of straw containing a white powder, which also tested positive for meth.

Officers also observed a fuse panel that was loose in the vehicle; when they removed the panel they found a white sock that contained a clear, plastic bag that contained 13.3 grams of meth; 12 hypodermic needles; a plastic bat that contained a tan/brown rock substance, which tested positive for heroin; a spoon that tested positive for heroin; a plastic bag containing a white residue that tested positive for cocaine; a plastic bag with a pink powder that tested positive for ecstasy and a bag that contained numerous pills.

Cochran admitted to officers he would sell between 1.5 to 2 ounces of meth every three days. He further admitted, the meth, syringes, ecstasy and heroin belonged to him, as he had been using heroin since 2009.

The second incident occurred April 25 the an officer with the Warsaw Police Department was northbound on Detroit Street, Warsaw, on April 25 when he recognized a passenger in a vehicle as Cochran, who had a felony warrant for his arrest. The officer followed the vehicle into a bait shop and approached him. Officers found meth on Cochran.

Judge Michael Reed sentenced Cochran to 5 years at the Indiana Department of Corrections for possession of meth and possession of a narcotic drug. Per the plea agreement several other charges were dismissed.

Cochran admitted during the sentencing that he has issues he wants to overcome, “I know I’ve got a problem.”

Area Teens Cited For Underage Drinking

NEW PARIS — In the early hours of June 11, Elkhart County Sheriff’s Department responded to reports of an underage party at a residence in the 18000 block of CR 48. Upon arrival, officers found multiple subjects under the age of 21 who had been consuming alcoholic beverages.

There were 13 individuals found to be under the age of 21. Three of these individuals were under the age of 18 and released to their parents, while the remaining 10 individuals who were over the age of 18, but under the age of 21, were issued tickets for illegal consumption of alcoholic beverages, and released at the scene.

Dewayne Miller, 41, of New Paris was cited and released for contributing to the delinquency of a minor.

Elkhart County Sheriff’s Teenage Alcohol Reduction team members assisting with the investigation include Cpl. Chad Hoien, Patrolmen Matt Newman, Brittaney Elsasser, Joshua Whitehead and Cody Ong.

The Elkhart County S.T.A.R. team is comprised of officers from the Elkhart County Sheriff’s Department. The S.T.A.R. team’s focus is to target and reduce underage drinking and smoking.

S.T.A.R. members continue to deter, intervene, and detect underage alcohol violations by educating the community and taking a proactive approach to deterrence and intervention when needed.

Former Warsaw Street Superintendent Pleads Guilty

Lacy Francis Jr.

WARSAW — Lacy Francis Jr., former Warsaw Street Superintendent pleaded guilty today, June 12, to several charges relating to his involvement in a scheme to intentionally over bill the City of Warsaw for work.

Pursuant to the plea agreement, Francis pleaded guilty to corrupt business influence, a Class C Felony; aiding theft, a class C felony; providing false information to a governmental entity to obtain a contract, a class D felony; and official misconduct, a class D felony.

The plea agreement states the executed sentence must be a minimum of two years. Additional time may be served on work release and probation if Lacy is approved.

Lacy is expected to pay full restitution to the City of Warsaw. The first installation of payment will be taken from Lacy’s retirement fund. He will then owe the city any of the remaining balance. The total restitution amount has yet to be determined.

Lacy’s plea deal acceptance and sentencing is slated for 8:30 a.m. Monday, July 24.

Pro Form, owned by Marc Campbell, schemed with Francis to receive bids on multiple city contracts. After obtaining the contracts, the company intentionally overcharged the City of Warsaw for the work. The Indiana State Board of Account performed an investigation and concluded that Campbell and Francis were both “jointly and severally liable to the city of Warsaw for overpayments in the amount of $318,569.”

Campbell pled guilty in March and was sentenced to serve one year on home detention followed by five years of probation.

Two other accomplices still face charges in regards to the incident. Lacy’s wife, Mildred Francis, faces money laundering charges. She is scheduled for a pretrial conference on June 26. Kevin Brown, a former Pro Form employee, faces five criminal charges. He is scheduled for a pretrial conference on June 26.

7:29 a.m. Monday, June 12, North SR 13, east of Executive Boulevard, Syracuse. Driver: Nathan J. Lane, 21, Aurora Road, Solon, Ohio. Lane was drowsy and began to serve off the road. When Lane corrected his vehicle, the rear passenger sign kicked out and struck a sign. Damage up to $5,000.

Officers with the Warsaw Police Department investigated the following accidents:

8:19 a.m. Monday, June 12, Lake City Highway and East Old Road 30, Warsaw. Drivers: Jessica L. Villa, 35, Rosemont Avenue, Warsaw, and Emily M. Newton, 18, East Ridge Drive, Warsaw. Villa “did not notice” if the light was green or red and struck Newton’s vehicle in the intersection. Villa is a habitual traffic violator and was transported to Kosciusko County Jail. Damage up to $5,000.

1:41 p.m. Monday, June 12, 1 Tiger Lane, Warsaw. Driver: Julia Cervantes, 39, Dot Street, Warsaw. Cervantes was backing from a parking space at Warsaw High School and hit a parked vehicle. Damage up to $2,500.

Winona Lake

Officers with the Winona Lake Police Department investigated the following accident:

12:31 p.m. Monday, June 12, 2403 E. Winona Avenue, Winona Lake. Drivers: James C. Pifer, 21, Willow Lane, Warsaw, and Douglas E. Protzman, 60, EMS B1A Lane, Leesburg. Pifer dropped his credit card in the Dairy Queen drive thru. As he reached down to get it his foot came off the brake and he rear ended Protzman. Damage up to $1,000.

 

UPDATE — Truck On Fire After Accident On US 30, CR 875W

ETNA GREEN — Saturday, June 10, at 1:06 p.m. Etna Township Fire and First Responders were dispatched to an accident between a pick-up truck and a semi on eastbound US 30 at the intersection of CR 875W, Etna Green. Kosciusko Sheriff’s Department was on scene.

Jason C. Klotz, 39, Etna Green, was the driver of the semi. Klotz was southbound on CR 875W and waited until both east and westbound lanes were clear before crossing US 30. Klotz crossed the westbound lanes and was in the eastbound lane when he was struck by the 1990 Ford F-150 driven by Timothy E. Simon, 21, Egg Harbor, N.J.

Initial reports stated that there were several occupants in the pick-up truck; according to police reports the pick-up truck had two occupants and the semi had five.

Simon sustained a fractured arm/elbow. His passenger complained of neck pain.

Klotz was uninjured. One passenger was believed to have head trauma; two other passengers complained of head and neck pain.

No more information is known at this time.


Warsaw Man Arrested After Robbing At Least Five Laundromats And Car Washes

WARSAW — A Warsaw man has been arrested stemming from a month long investigation by the Kosciusko County Sheriff’s Department and the Milford Police Department.

Mychal David Loper

Preliminary charges of felony theft and criminal mischief have been filed by Kosciusko County Sheriff’s Detectives against Mychal David Loper, 27, Warsaw.  Investigators stated that Loper allegedly vandalized and robbed at least five different laundromat and car wash coin machines in the last month.  Officers from the Milford Police Department were originally contacted on May 30 in regards to damage and theft from a coin machine at the Hometown Laundry in the town of Milford.  K.C.S.D. Detectives also responded to the scene and viewed video surveillance footage of a male subject breaking into numerous machines and stealing money.

K.C.S.D. Detectives were able to ascertain information that Mychal David Loper was a possible suspect in the Milford incident, and subsequently discovered he was already incarcerated in the Kosciusko County Jail on an unrelated failure to appear misdemeanor warrant. 

During an interview with detectives, Loper admitted to his involvement with the Milford theft, along with four additional thefts in the Warsaw area from coin operated machines at laundromats and car washes.  Loper also provided information to officers that he had allegedly stolen a pair of bolt cutters from the Nappanee Ace Hardware with the intent to vandalize and steal money from the coin machines at a laundromat in Nappanee.

Detectives stated that they are still currently investigating the possibility that Loper might have been involved in other similar crimes prior to his arrest.

The Kosciusko County Prosecutor’s Office advises that the defendant’s charge is merely an accusation and that the defendant is presumed innocent until proven guilty in a court of law.

BREAKING — Barn Fire On CR 950S In Silver Lake

Emergency personnel were called to a barn fire in Silver Lake.

SILVER LAKE — At approximately 5:10 p.m. Tuesday, June 13, Burket Fire Department was contacted regarding a possible barn fire on CR 950S in Silver Lake.

Silver Lake and Claypool fire departments were called shortly after this for full assists to the fully involved barn fire. Mentone Fire Department was then contacted for a tanker assist to this area.

Traffic was being diverted away from the area as emergency personnel worked to get the fire under control. No other information is known at this time.

9:31 a.m. Tuesday, June 13, South Scott Street and East Center Street, Warsaw. Drivers: Mary E. Grubbs, 82, West Main Street, Warsaw, and Lorne J. Rearick, 79, South Scott Road, Claypool. Grubbs was traveling north on Scott Street and had stopped at a red light. Grubbs stated the vehicle in front of her turned right onto Center Street, causing Grubbs to think the light had turned green. Grubbs proceeded to travel north into the intersection but was struck by Rearick. Damage up to $5,000.

11:16 a.m. Tuesday, June 13, North Buffalo Street and East Fort Wayne Street, Warsaw. Driver: Steven D. Shankster, 38, East CR 900S, Claypool. Shankster struck an unoccupied, parked vehicle in a parking lot. Damage up to $2,500.

2:21 p.m. Tuesday, June 13, 3318 Lake City Highway, Warsaw. Drivers: Maria L. Hernandez, 43, West Third Street, Ligonier, and Jeffrey L. Ruff, 57, Grace Avenue, Winona Lake. Hernandez was traveling through a parking lot. Hernandez failed to see Ruff traveling through the parking lot a the same time and the two collided. Damage up to $10,000.

Milford Man Dies In Single Vehicle Accident

NEW PARIS — A Milford man lost his life in a single vehicle accident at 7:41 a.m. today, Wednesday, June 14, east of New Paris. The accident was on CR 31, north of CR 50.

Elkhart County Sheriff’s Department officials reported the driver was northbound on CR 31, north of CR 50 in his 2006 Chevrolet  when the vehicle went off the roadway on the west side of the road. The vehicle overturned multiple times.

He was pronounced dead at the scene.

The crash is under investigation by the Elkhart County Sheriff’s Department. New Paris Fire and EMS and Turkey Creek Paramedics responded to the scene.

5:51 a.m. Tuesday, June 13, East CR 1300N, north of North CR 100E, Milford. Driver: Dallas E. Yoder, 22, County Road 40, Goshen. Yoder lost control of the vehicle while attempting to make a turn. Damage up to $10,000.

2:57 p.m. Tuesday, June 13, South Huntington Street, south of East Pittsburg Street, Syracuse. Drivers: Brandon W. Miller, 22, East Wawasee Drive, Syracuse, Kathleen M. Harper, 49, Shawnee Drive, Warsaw, and Lee A. Piercy, 29, Short Street, Nappanee. Miller rear-ended Harper’s vehicle, causing Harper to rear-end Piercy’s vehicle. Harper and Piercy were transported to the hospital for complaints of pain. Damage up to $10,000.

Warsaw

Officers with the Warsaw Police Department investigated the following accident:

11:33 a.m. Wednesday, June 14, East Market Street and South Tamarack Street, Warsaw. Drivers: Chandler T. Newsome, 17, West Kiwi Road, Claypool, and Jay A. Beaman, 46, North CR 575E, Hope. Newsome rear-ended Beaman’s vehicle. Damage up to $2,500.

  • 1:24 p.m. Tuesday, June 13, 1200 block of Lake City Highway, Warsaw. Employees at Meijer reported theft of over $200 worth of alcohol.
  • 8:11 a.m. Tuesday, June 13, 300 block of North Indiana Street, Warsaw. A bicycle was reported found at Central Park.
  • 11:53 p.m. Tuesday, June 13, 3700 block of Lake City Highway, Warsaw. A male reported an animal bite.

Brown Faces Battery Charge

Kayla Brown

WARSAW — A Syracuse woman was arrested after beating her ex-girlfriend.

Kayla Brown, East CR 1300N, Syracuse, is being charged with battery causing moderate injury, a level 6 felony.

On June 12, an officer responded to a battery that had occurred in Syracuse. The officer observed the victim had multiple bruises on her arms and forehead, a bruised and swollen eye and red marks and scrapes on both sides of her neck.

The victim stated she had spent the day with her ex-girlfriend, Brown. After returning to the victim’s home, Brown became irate when the victim received a text from another person.

The victim stated Brown started grabbing the victim, striking her with her fists and biting her upper lip. The victim also noted Brown had grabbed the victim’s iPhone and threw it on the ground, breaking the phone.

Brown was booked in the Kosciusko County Jail on June 12.

Brown had been arrested last month for drunk driving and head butting an officer.
