WARSAW — Terry Duane Ramsey, 66, 9509 Tomahawk Trail, Fort Worth, Texas, was booked into the Kosciusko County Jail late this morning, Nov. 23, on a charge of theft, a level 6 felony.
Ramsey is charged with knowingly or intentionally exerting unauthorized control over the property, of Flexaust Incorporated, in the sum of $19,600.
Court documents state on Aug. 19, an employee of Flexaust Incorporated filed a complaint with the sheriff’s department regarding to a theft by Ramsey, owner of Texas Equipment Sales Company. The local company dealt directly with Ramsey to purchase a boiler. The agreement was for Flexaust to pay $20,000 for a 60 hp Burnham boiler to the company. The payment was made on Feb. 18 with the boiler to be shipped on Feb. 26. As of March 6, the boiler had not arrived so the company pulled back the payment.
The boiler was delivered on March 9. The company thought they had successfully pulled back the first payment, so a second ACH payment was sent to Ramsey on April 2. When the company realized they had paid the $20,000 twice, Ramsey was contacted and stated he did not have the funds to return one of the payments. On July 22, the company did receive $400 via a money order, leaving an unpaid balance of $19,600.
The sheriff’s department was able to contact Ramsey via email who stated he intended to pay the company the money owed, but could only do so $500 at a time. This was not acceptable to the company.
