Timothy Dmitriy Freeman

KOSCIUSKO — A Warsaw man was sentenced today in the Kosciusko Superior 1 Court on charges related to three separate cases.

Timothy Dmitriy Freeman, 23, 346 Deerwood Court, Warsaw, was found guilty of intimidation, a level 6 felony; criminal confinement, a level 5 felony; battery, a level 5 felony; and possession of methamphetamine, a level 6 felony.

Freeman was arrested Oct. 1, 2017, after fleeing from police. When officers located him the following day, Freeman reportedly was in possession of methamphetamine and a syringe. He was booked into the Kosciusko County Jail on Oct. 14, 2017.

On Oct. 15, 2017, an inmate in the Kosciusko County Jail advised he did not want to go back into the holding cell because four inmates had forced him to put his finger in one of their rectums, stolen his lunch tray, hit him with sandals, kicked him and would not let him use the call button to ask for help. He further advised he was very intimidated and scared to go back into the cell. He identified the four inmates as Freeman, Christopher Orr, Danny Combs and Tyler Martin.

According to the affidavit of probable cause, Martin wanted everyone’s muffins at breakfast and became angry because the victim had eaten part of his. Combs, Martin and Freeman threatened to hurt the victim throughout the day. At one point, Freeman told the victim to put his finger into Freeman’s rectum or he was going to beat him. Orr was going to put toilet paper in front of the camera so Freeman and Martin could hurt him if he did not put his finger in Freeman’s anus.

The victim was then forced to put butter onto his finger and insert his finger into Freeman’s rectum. The victim advised he was scared and intimidated and thought if he did not insert his finger, the men would hurt him. He further advised that Orr dumped a cup of urine on his head, Combs kicked him in the abdomen and Freeman struck him in the face.

An officer within the jail observed the surveillance video. The video showed the actions described by the victim. Phone calls were listened to in which Martin advised he watched a man touch another man’s rectum, Combs advised he made someone touch another person’s rectum and Orr told a female about all the incidents that had occurred.

Sentencing for the two charges in the first case are to be served concurrently; however, sentencing in each case was ordered to be served consecutively. Judge David Cates sentenced Freeman to a combined total of 12 1/2 years in the Indiana Department of Corrections, with one year of that sentence to be suspended and served on probation.

Remaining charges were dismissed, pursuant to the plea agreement.

Scott Noble, 26, 14290 US 6, Syracuse, is being charged with burglary, a level 5 felony; and theft, a level 6 felony.

Mitchell Andrew Reynolds, 27, 1217 Magnolia Ave., Elkhart, is being charged with aiding, inducing, or causing burglary, a level 5 felony; theft, a level 5 felony; and criminal gang activity, a level 6 felony.

Nicholas Randall Garber, 18, 71 E. South St., Milford, is being charged with burglary, a level 5 felony; theft, a level 5 felony; and auto theft, a level 6 felony.

On Aug. 6, an officer with the Kosciusko County Sheriff’s Department responded to a report of burglary and theft. The officer spoke with the owner of Deatsman Farms, who said somebody entered the business and stole a safe, approximately $20,000 in cash, two handguns, a Remington 20 gauge shotgun, a 22 caliber Remington rifle and a drone.

According to the affidavit of probable cause, on Aug. 4, officers with the Kosciusko County Sheriff’s Department responded to a report of a suspicious subject with a motorcycle at the Leesburg Marathon. The caller said a male subject needed tools to open the gas tank for the motorcycle because the keys broke off in the gas tank. Finding this suspicious, the caller contacted police.

When officers arrived at the scene, they found the motorcycle parked with no one around it. Later, officers received information from the Noble County Sheriff’s Department that the motorcycle had just been reported stolen in Noble County.

Officers obtained surveillance video from the Leesburg Marathon and identified the male subject with the motorcycle as Nicholas Garber. After receiving information on Garber’s whereabouts, officers went to a Milford residence and found several subjects present, including Noble, Deskin and Miller.

An officer spoke with Noble, who was standing next to a fire. While speaking with Noble, the officer observed paperwork with the name Deatsman Farms at the edge of the fire. Noble said he was cleaning out a back shed at the residence. The officer noticed a safe dial, handle and safe fireproof clay laying on the ground.

Officers searched the residence and discovered a large amount of personal paperwork for the Deatsman Farms, as well as the firearms and drone stolen from the business. While officers searched Noble, they found $2,170 in his pocket.

Officers also searched Miller and discovered $500 on her person. Deskin was also searched. She had $2,950 on her person, as well as $1,000 in a band dated 2013. The owner of Deatsman Farms said some of the money in the safe had been there for a period of time and would have had an old band date on it.

Noble said his sister gave him the money. His sister denied giving him any money.

Miller said Noble gave her the $500. Deskin said Garber gave her the $2,950.

Officers went to another residence in Milford in an attempt to locate Garber. The owner of the residence said Garber and a second male subject, identified as Mitchell Reynolds, came to the residence earlier in the day with a 20 gauge shotgun and a new safe still in its box. Garber and Reynolds took $2,000 in cash with them and placed approximately $9,000 inside the safe. The two left the new safe and shotgun at the residence. The owner of Deatsman Farms identified the shotgun as stolen from his business.

Officers then obtained a search warrant for the new safe. Inside, they found a wallet belonging to Reynolds, an iPad, empty iPhone box, syringe and scales.

Officers located Reynolds and discovered $925 inside his vehicle. Reynolds told officers he and Noble cut open the stolen safe. Reynolds also said he received $5,000 from the money in the safe.

With the money, Reynolds purchased a vehicle and spent $1,500 at WalMart to purchase drugs, leaving him with $925 left over. He admitted he and Noble are members of the Aryan Brotherhood gang.

Garber admitted he stole a motorcycle. He also stole a truck while at Neibert’s Produce in Leesburg. While at Neibert’s Produce, Garber broke into the money box and stole cash from it. He used the truck and stole a safe, security system and firearms from Deatsman Farms alongside Noble. He said both Noble and Reynolds are attempting to recruit him into the gang.

Noble, Deskin, and Miller were booked in the Kosciusko County Jail on Aug. 6. Reynolds and Garber were booked in the Kosciusko County Jail on Aug. 8, each on a $100,000 surety and cash bond.

SILVER LAKE — A Silver Lake man was recently arrested for child molestation. Evidence shows he transmitted Chlamydia to his minor victim.

Trey Michael Burbank

Trey Michael Burbank, 25, 11144 S. County Farm Road, Silver Lake, is being charged with child molestation, a level 1 felony.

On June 11, an officer with the Kosciusko County Sheriff’s Department responded to a local hospital in regards to a possible child molestation. A minor female told officers that Burbank had been molesting her for a long period of time.

The minor was cleared by the hospital and taken to Kosciusko County Sheriff’s Department for an interview. The minor told officers that she used Facebook to tell her parents that Burbank had been raping her at night. She told officers that Burbank touches her inappropriately and had sex with her on multiple occasions. She stated that the first time occurred on Dec. 2, 2017, and continued through June 2018. According to the minor, the inappropriate acts occurred in his bedroom at his Silver Lake residence and in a camper.

On June 12, the minor had a follow-up appointment with the Fort Wayne Sexual Assualt Center. The minor tested positive for Chlamydia, a sexually transmitted disease.

Burbank submitted to a Chlamydia test on July 14, and tested positive. Burbank stated that the minor must have contracted Chlamydia from using sex toys. A doctor advised that Chlamydia is a weak virus and it does not live long outside of the body. She advised it is highly unlikely for the minor to have contracted Chlamydia from using a sex toy.

Burbank was booked into the Kosciusko County Jail on Aug. 9, with a $50,250 surety and cash bond.

WARSAW — A Warsaw man was arrested after burning candles led police to discover he was manufacturing methamphetamine inside an abandoned building.

Benjamin Jacob Albright

Benjamin Jacob Albright, 39, 804 N. Old Orchard Drive, Warsaw, was booked for possession of a precursor, manufacturing methamphetamine and possession of methamphetamine.

On Aug. 6, an officer with the Warsaw Police Department responded to a possible fire at the Arnolt building. Upon arrival, the officer observed three candles burning and a male subject sleeping. The officer woke the subject up and identified him as Albright. While speaking with Albright, the officer observed Coleman fuel and other items. He recognized the items as precursors for manufacturing methamphetamine.

Upon searching the area, the officer discovered lye, sulfuric acid, ammonium nitrate, empty packages of Sudafed, a plastic bottle with a tube coming from the lid. The plastic bottle had smoke exiting it. The officer was able to identify the objects as a one-pot methamphetamine lab.

Albright admitted he purchased the items and drove to the building on his moped. He further admitted to manufacturing methamphetamine.

Albright was booked into the Kosciusko County Jail on Aug. 7, with a $15,250 surety and cash bond.
