The impact of the collision resulted in both vehicles traveling a distance into a corn field on the southwest corner of CR 200E and Armstrong Road.

LEESBURG — One person was injured in a two-vehicle accident today at 10:21 a.m. Monday, July 2. The accident was at Armstrong Road and CR 200E, east of Leesburg.

Melissa L. Brody, 32, Whitefield Road, Northbrook, Ill., complained of pain to the hip/upper leg area. She was taken to Parkview Hospital, Fort Wayne, by private vehicle.

According to the Kosciusko County Sheriff’s Department, Brody was southbound on CR 200E in a 2017 Hyundai Tucson. She stopped her vehicle at the intersection of Armstrong Road, but failed to see a westbound 2015 Dodge Ram pickup truck operated by Randal L. Litwiller, 63, Longwood Court, Goshen, before pulling out into the intersection.

Litwiller’s truck struck the driver’s side door of Brody’s vehicle. Both vehicles ended up in the cornfield on the southwest corner of the intersection. The collision also caused the fifth-wheel flatbed trailer being pulled by the Dodge to come unhitched and hit the back of the truck.

Damage was estimated up to $50,000, including damage to the corn in a field owned by Wanita Boggs, East Armstrong Road, Leesburg.

Litwiller and his passenger were not injured.

Lutheran EMS and Leesburg Fire Department responded. The accident is being investigated by the Kosciusko County Sheriff’s Department.

A t-bone-style collision occurred July 4 between a green minivan and a maroon SUV just west of the Devil’s Backbone.

Emergency personnel transport a female patient from the accident scene to the awaiting ambulance.

PALESTINE — A man and woman were injured Wednesday, July 4 in a two-vehicle collision just before noon as temperatures continued to flirt near the 90s.

Emergency personnel from Mentone and Burket, as well as police from the Kosciusko County Sheriff’s Department, were called by county dispatch at 11:28 a.m. Wednesday for a t-bone-style collision at the intersection of SR 25 and CR 400W, just west of the Devil’s Backbone.

The accident involved a hunter green Chevrolet Uplander minivan and a maroon Ford Explorer sport utility vehicle.

Two males occupied the Uplander and a man and woman were occupying the Ford SUV.

Dispatchers told first responders that at least one male appeared shaken up at the scene, although it was unclear which vehicle that male had been traveling in.

One of the occupants of the minivan said they had been traveling southbound on CR 400W and stopped at the intersection with SR 25.

“There was a line of traffic that way (east) as far away as that ambulance is now,” he said. “We watched that traffic and didn’t pay as close of attention the other way and started on across and we heard them slam on their brakes.”

The Ford Explorer had been traveling eastbound on SR 25 and began to slow dramatically before striking the minivan in the passenger’s side door, spinning the green vehicle around until it came to rest adjacent a steel I-beam corner post, facing northwest.

The man and the woman from the SUV both complained of pain to numerous areas and were transported to the hospital by ambulance.

On May 29, an arrest warrant was issued in Kosciusko Circuit Court for Bradberry with charges in dealing methamphetamine and possession of methamphetamine.

According to the affidavit of probable cause, on July 2, officers arrived at a residence to take Bradberry into custody for his outstanding warrant. Upon arrival, officers observed Hicks, Bradberry’s mother, exit a vehicle that was parked in the driveway.

Officers asked Hicks if Bradberry was home. Hicks stated that he was inside the residence.

While apprehending Bradberry, officers saw a grinder laying on a nightstand and detected the odor of marijuana. An officer stayed outside of the residence with Searfoss, who was sitting in a vehicle.

Searfoss gave officers consent to search a vehicle on the property. Inside the vehicle, officers discovered a flashlight that contained a plastic bag with a crystal substance and a syringe. The substance tested positive for methamphetamine. Searfoss admitted the methamphetamine and syringe belonged to him.

Bradberry admitted to officers that there was approximately three ounces of marijuana and digital scales in the residence. He also stated that he occasionally sells marijuana for about $200 per ounce.

According to the affidavit of probable cause, officers also interviewed Rex, who was inside the residence when officers arrived. Rex stated he had stayed at the residence over the weekend and smoked marijuana. Homer Dewayne Hall

WARSAW — A Warsaw man was arrested after throwing a beer can at a woman.

Homer Dewayne Hall, 47, 536 E. Center St., Warsaw, is being charged with domestic battery with a child under 16 present, a level 6 felony; and domestic battery, a class A misdemeanor.

On June 7, officers responded to a report of battery in a moving vehicle. According to the affidavit of probable cause, officers could not locate Hall at the scene and spoke with a female subject at her residence.

The female stated that she and her sister picked up Hall and a minor. Hall became angry inside the vehicle and intentionally struck the female in the head with a beer can, causing her physical pain. He then poured the beer onto her.

The female told Hall to get out of the vehicle, and he walked away with the minor.

Hall was booked in the Kosciusko County Jail on July 3, with a $5,250 surety and cash bond.

Woman Who Police Say Attacked People With SUV Receives Sentence

WARSAW — A Warsaw woman was sentenced to two and a half years in county jail for driving her vehicle into a garage, striking three people in the process. Because the woman’s intent was ambiguous, she could likely serve her sentence outside of a jail cell.

Billie Jo Frantz

Billie Jo Frantz, 34, 413 S. High St., Warsaw, was initially charged with two counts of battery by means of a deadly weapon, a level 5 felony; leaving the scene of an accident with serious bodily injury, a level 6 felony; aggravated battery, a level 3 felony; and criminal recklessness, a level six felony.

On May 31, Frantz pleaded guilty to leaving the scene of an accident with serious bodily injury and criminal recklessness. The other charges were dropped in exchange for her guilty plea. She appeared in Kosciusko County Superior Court One for sentencing today, July 5.

Officers with the Kosciusko County Sheriff’s Department were called to a residence in the county on Sept. 24, 2017, where three people were struck by a vehicle, one seriously.

According to the police report, victims at the scene told officers that Frantz drove a white GMC sport utility vehicle into a driveway, accelerated and drove the vehicle into a garage, striking two women and one man.

One of the women was pinned against a vehicle inside the garage and suffered numerous injuries, including a large cut on her left thigh.

The victims and witnesses at the scene said Frantz said nothing, but backed the vehicle out of the garage and left the scene. She later turned herself in at the sheriff’s department.

According to police, a male at the scene who was not harmed in the incident told officers that Frantz was his ex-girlfriend and that he believed she drove into the garage out of jealousy because he was with another woman.

After her surrender to police, Frantz reportedly told investigators she drove to the residence and into the driveway, but that the brakes failed, causing her vehicle to proceed into the garage.

Frantz’s brother, who drove her in her own vehicle to turn herself in, told police the brakes on her vehicle were working properly. He also reportedly told police that Frantz informed him, prior to the incident, she was going to her ex-boyfriend’s house to have words, and possibly a fight.

At the sentencing hearing, Prosecutor Brad Voelz told the court that the incident had been costly for the victims.

“It seems to me a case where restitution might be an issue,” Voelz said, asking the court for a 30-day period to investigate if Frantz should be liable for certain victim costs.

“It’s a tough case, judge,” continued Voelz. “It [the case] was filed on the strength of aggravated battery. I spoke to two of the victims.”

According to Voelz, one of the victims had described herself as a former best friend to Frantz.

“She said she can’t believe that Billie Jo would do anything intentional to hurt someone,” said Voelz. “Intent in this case is difficult to prove.”

Frantz’s attorney, Eldon Stoops agreed with the prosecution. “It was a reckless act, but not an intentional act,” he said.

‘I am very sorry for anyone I hurt,” said Frantz.

Superior Court One Judge David Cates told Frantz that while it may be hard to prove whether she drove her vehicle into the garage on purpose, there was nothing ambiguous about her failing to stick around after the incident.

“There may not be an issue regarding intent in terms of criminal recklessness,” said Cates. “But there is no question of intent regarding leaving the scene.”

Cates sentenced Frantz to one year in the Kosciusko County Jail for leaving the scene. He added one and one half years for the criminal recklessness charge, but suspended that sentence in lieu of probation.

For the one-year sentence, Cates told Frantz she could have one week to apply for either work release or community corrections as options to her one-year sentence. If she qualifies, Cates told Frantz he would allow her to serve that sentence in one of those programs instead of behind bars. She was given three days jail time credit.
